Refund & Returns Overview Poland
IF YOU HAVE RESIDENCE IN POLAND, THE FOLLOWING CLAUSES SHALL APPLY. IN CASE OF ANY DISCREPANCY BETWEEN THE CONDITIONS SET OUT ABOVE, AND THE FOLLOWING CLAUSES, THE LATTER WILL APPLY.
1.GENERAL INFORMATION
Clause 1.1 above shall be replaced by the following:
1.1Please note that due to health protection or for hygiene reasons we do not accept returns (you have no right of withdrawal a contract) of perfume, earrings, swimwear or underwear which are packed in sealed packaging when delivered to you, if that sealed packaging has been opened after delivery. This does not affect your statutory rights resulting from the non-conformity of the product with the contract.
Clause 1.3 above shall be replaced by the following:
1.3 Please include the completed return form documentation provided with your delivery in your return parcel.
Clause 1.4 above shall be replaced by the following:
1.4 Your delivered parcel will also include a pre-paid returns label, generated with the assigned parcel carrier. If you want to return the product, please affix the pre-paid returns label to your parcel, which will help us to promptly accept and process the parcel.
Clause 1.5 above shall not apply.
Clauses 1.6 – 1.9 above shall be replaced by the following:
1.6 Return the item in its original condition. You have the right to examine the nature, characteristics and functioning of the goods as you would in a stationary store. However, if you wish to return the item you may not use the item in an unrestricted manner.
If the item you return does not match its original condition, you may be liable for the deterioration of the returned item and We may have the right to charge you additional costs for the diminished value of the goods. Remember, that the consumer is liable for any diminution in the value of the item due to improper use.
After the Vendor has received the returned products and checked the condition, you will receive an email confirming acceptance.
1.7 If you plan to return items, please do not remove the tag and seal from the items. Items should be returned in their original packaging. This does not affect your right to withdraw from the contract or your statutory rights resulting from the non-conformity of the product with the contract.
1.8 Shoe boxes are considered an intrinsic part to the product and should be protected and returned undamaged.
1.9 Faulty, defect or missing items shall be reported to Customer Services within 48 hours of receiving your delivery. This does not affect your statutory rights resulting from the non-conformity of the product with the contract.
Clause 1.11 above shall be replaced by the following:
1.11 You shall always ensure that the goods are well protected when returned to Us.
Clause 1.13 above shall be replaced by the following:
1.13 We encourage you to make returns via the authorised returns process, using the pre-paid returns label provided.
Clause 1.14 above shall be replaced by the following:
1.14 Please note that goods bought via the online store cannot be returned to any other Vivienne Westwood store. Exchanges are not available for online purchases. Goods bought at any Vivienne Westwood store cannot be returned at our online store.
Clause 1.15 above shall be replaced by the following:
1.15 If the returned item received by Us is in its original condition (i.e. it is not damaged), We will refund you the full price of the product. If the returned products are damaged, We will inform you on the costs for the diminished value of the product.
You will be notified if the returned products such as perfume, earrings, swimwear or underwear cannot be accepted. In this case, you may choose to have the products returned to you at your own expense.
4. SHIPPING FOR RETURN
Clause 4.1 above shall not apply.
Clause 4.2 above shall be replaced by the following:
4.2 OTHER COURIERS: We encourage you to make returns via the authorised returns process, using the pre-paid returns label provided. If you decide to use a different courier to the one indicated by the Vendor, you will have to pay for the cost of return shipping upfront. Please note, that since the shipping will be international, the cost of this shipping may be higher than normal domestic postal shipping cost. In addition, you will be responsible in case of loss or damage to the products during transport.
5. REFUND
Clause 5.1 above shall be replaced by the following:
5.1 After the Vendor has received the returned products and checked that all the requirements have been met, you will receive an email confirming acceptance.
Whatever the form of payment you used (credit/debit card or cash on delivery), we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by Us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from the contract, unless we decide to withhold refund.
The refund procedure will start as soon as possible. We will carry out such reimbursement using the same means of payment as used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Clause 5.3 above shall be replaced by the following:
5.3 The time period for refunding the amount you paid for purchasing the returned products depends on the payment type used, however it will not take longer than 14 days from the day on which we are informed about your decision to withdraw from this contract, unless we decide to withhold refund.
We may withhold refund until we have received the products back or you have supplied evidence of having sent back the products, whichever is the earliest.
If we decide to withhold the refund, we will inform you about it by e-mail. You will receive your refund within 14 days from the date your return is received at our warehouse or you have supplied evidence of having sent back the products (whichever is the earliest). An e-mail notification will be sent once we receive your item.
Clause 5.9 above shall be replaced by the following:
5.9 The refund will be visible on your PayPal account. Repayment to the credit card you use with your PayPal account depends on the credit card issuer.
6. FAULTY ITEMS
Clause 6.2 above shall be replaced by the following:
6.2 We are liable for the non-conformity of the goods with the contract existing at the time of their delivery and revealed within two years from that moment. For further details please refer to points 3.11 – 3.15 of the Terms and Conditions of sale. If you return an item that is faulty, the shipping costs will be refunded.
We would encourage you to report any faults within 48 hours of delivery (please note, if you do not report the fault within this time frame your statutory rights resulting from the non-conformity of the product with the contract will remain unaffected).
If you report faults up to 30 days from their delivery – and your goods are deemed to be faulty, then you can get an immediate refund. This does not affect your statutory rights resulting from the non-conformity of the product with the contract.
If you report faults up to 2 years from their delivery and your goods present a fault which would have existed at the point of purchase, points 3.11 – 3.15 of the Terms and Conditions of sale shall apply. Once we have received the faulty item, we will carry out a thorough investigation and contact you with our outcome.
