Refund & Returns Overview Romania
IF YOU HAVE RESIDENCE IN ROMANIA, THE FOLLOWING CLAUSES WILL BE APPLIED:
1. GENERAL INFORMATION
1.1 Please note that we do not accept returns of:
- perfume without sprayer, earrings, swimwear, underwear or any other products which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
- goods made to the consumer’s specifications or clearly personalised;
- goods which are liable to deteriorate or expire rapidly;
- goods which are, after delivery, according to their nature, inseparably mixed with other items;
- any other goods which, by law, are excepted from the right of withdrawal.
This does not affect your statutory rights.
1.6 Return the item in its original condition: if the item you return does not match its original condition, we reserve the right to hold you liable for any diminished value of the items resulting from the handling of the items other than what is necessary to establish the nature, characteristics and functioning of the items.
1.7 Items must be returned in their original packaging with the swing tags attached, otherwise you will be held liable for any diminished value of the items resulting from the handling of the items other than what is necessary to establish the nature, characteristics and functioning of the items.
1.8 Shoe boxes are considered an intrinsic part to the product and in particular should be protected and returned undamaged. Damage to the box will render the goods diminished in value, for which the consumer will be held liable.
1.9 Faulty, defect or missing items must be reported to Customer Services within 48 hours of receiving your delivery (please note, if you do not report the fault within this time frame your legal rights, including the withdrawal right of 14 days (as provided by the Conditions of Sale), will remain unaffected). If you return an item that is faulty, the shipping costs will be refunded.
1.11 The Vendor does not take responsibility for damage that occurs during the return process; please ensure that the goods are well protected when returned to us. This does not affect your rights against the carrier.
1.14 Please note that all refunds for online purchases can only be made through our website or by any other unequivocal statement setting out your decision to withdraw from the contract. Exchanges are not available for online purchases. Goods bought via the online store cannot be returned to any other Vivienne Westwood store.
Goods bought at any Vivienne Westwood store cannot be returned at our online store.
1.15 If you have met all the conditions requested, you will be refunded the price of the products purchased, as well as the shipping costs. You will be notified if the returned products cannot be accepted or may be accepted on the condition that you will bear the products’ diminution in value due to failure to comply with the conditions set out above. In this case, you may choose to have the products returned to you at your own expense. If you refuse this delivery, the Vendor reserves the right to retain the products and the amount paid for your purchase of the products.
2. HOW TO RETURN AN ITEM
1. FILL IN THE RETURN FORM
1.1 You will then need to complete the Returns Form, that was received with your order. Please read the instructions listed on the return form to provide the relevant return reason. The completed Return Form will need to be included in your return parcel to process the refund promptly. If you have lost the Return Form, you may contact Customer Services to receive a replacement.
You can also inform the Vendor of your decision to withdraw from the contract by making any other unequivocal statement in this respect (e.g. by e-mail or phone).
4. SHIPPING FOR RETURN
4.2 OTHER COURIERS: Any returns received independently or outside of our returns process will not be accepted. If you choose to use another courier service your return will not be accepted or eligible for refund or credit. If you decide to use a different courier to the one indicated by the Vendor, you will have to pay for the cost of return shipping upfront and you will be responsible in case of loss or damage to the products during transport. This does not affect your rights against the carrier.
5. REFUND
5.1 After the Vendor has received the returned products and checked that all the requirements have been met, you will receive an email confirming acceptance.
Whatever the form of payment you used (credit/debit card ), the refund procedure will be performed as soon as possible, no later than fourteen (14) days from when the Vendor was informed of your decision to exercise your right to return the purchased products and once the Vendor has checked that the return was carried out in compliance with the above conditions.
6. FAULTY ITEMS
6.2 letter c. up to 2 years: if your Goods present a fault which would have existed at the point of purchase, you may obtain the restoration of the conformity of the goods (repair or replacement), receive a price reduction, or terminate the contract, pursuant Article 11 of Government Emergency Ordinance no. 140/2021. We may refuse to bring the goods into conformity if repair and replacement are impossible or would impose costs that would be disproportionate for us. Once we have received the faulty item, we will carry out a thorough investigation and contact you with our outcome. After 1 year from the date of receipt, you will be obliged to provide sufficient proof that the fault would have existed at the point of delivery.
