Refund & Returns Overview Poland

IF YOU HAVE RESIDENCE IN ITALY, THE FOLLOWING CLAUSES WILL BE APPLIED:

1. GENERAL INFORMATION

Clause 1.1. is replace by the follow:

Please note that we do not accept returns of perfume, earrings, swimwear, or underwear for hygienic reasons, except in cases where the product is still sealed. This does not affect your statutory rights.

Your statutory withdrawal right:

Nothing in this returns and refunds policy limits your statutory rights. By law, you can withdraw from the contract within 14 days. This periods starts:

  1. in the case of a single item, on the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the products;
  2. in the case of multiple products ordered by you in one order and delivered separately, on the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the last product;
  3. in the case of delivery of a product consisting of multiple lots or pieces, the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the last lot or piece.

You can exercise this withdrawal right by any means feasible. For example, you can complete the return form documentation provided with your delivery and use the pre-paid returns label to send back the package.

Clause 1.9 will not apply.

2. HOW TO RETURN AN ITEM

1. FILL IN THE RETURN FORM

This clause is replace by the follow:

1.1 You may choose to complete the return form you received with your order, or notify us by free email communication to the contact information provided, depending on which is the Vendor (Vivienne Westwood Limited Vivienne Westwood Limited, with registered office  at Westwood Studios, 9-15 Elcho Street, London SW11 4AU, United Kingdom, or Vivienne Westwood S.r.l., with registered offices at Corso Venezia 25, 20121, Milan, Italy). You can understand the Vendor from the Order confirmation and from the type of product you have purchased (please refer to section A) or B) of the Terms and conditions of sale’s (“Condition”) introduction. You are not obliged to specify the reason for returning the product.

If you withdraw from the contract, you must return the products received to us without delay, but no later than fourteen (14) days from the date of the declaration of withdrawal.

4. SHIPPING FOR RETURN

Clause 4.1 is replaced by the follow:

4.1 If you decide to return the product, the Vendor will refund the costs incurred in the purchase, including shipping costs. If you use the pre-paid returns label provided by US, return costs are for free.

4.2 OTHER COURIERS: Any returns received independently or outside of our returns process will not be accepted. f you decide to use a different courier to the one indicated by the Vendor, you will not be reimbursed for additional delivery costs and you will be responsible in case of loss or damage to the products during transport.

5. REFUND

Clause 5.1 is replaced by the follow:

After the Vendor has received the returned products and checked that all the requirements have been met, you will receive an email confirming acceptance.

If you returned the product as per your right to withdraw, the refund will be made without undue delay and at the latest within fourteen (14) days from the date on which you informed the Vendor of your decision to withdraw in accordance with the provisions of article 7.1 of our Terms and Conditions. The Vendor may however defer reimbursement until the products are recovered or until the consumer has provided proof of the dispatch of these products, the date chosen being that of the first of these events. If you have expressly opted for a method of delivery other than the cheapest standard delivery offered by us, you are not entitled to reimbursement of the additional costs incurred by you as a result.

6. FAULTY ITEMS

6.2 letter c) is replaced by the follow:

Up to 2 years: we assume that the products have been defective since the moment of purchase. In these cases, you may obtain the restoration of the conformity of the products (repair or replacement pursuant Article 135 bis-ter and quarter of Legislative Decree 206/2005 as modified), receive a price reduction, or terminate the contract provided that the remedy chosen is not impossible or imposes disproportionate costs for us. Once we have received the faulty product, we will carry out a thorough investigation and contact you with our outcome. After two (2) years from the date of receipt, you will be obliged to provide sufficient proof that the fault would have existed at the point of purchase.
